OPINION

MILLER, Judge.

Before the court is plaintiffs application for attorneys’ fees and expenses pursuant to the Equal Access to Justice Act (the *80“EAJA”), 28 U.S.C. § 2412 (1994 & Supp. V 1999). Among the issues to be decided are whether and to what extent plaintiffs failure to succeed on certain damage claims affects it recovery. Argument is deemed unnecessary.
