SIMANDLE, District Judge.

The National Flood Insurance Program uses private insurers acting as fiscal agents of the United States Treasury to adjust and pay flood insurance claims for covered losses. The defendant in this case, Omaha Property & Casualty Insurance Company (“Omaha” or “Defendant”), is such a private insurer and issued a Standard Flood Insurance Policy (“SFIP”) to plaintiffs Joseph L.
