MICHEL, Circuit Judge.
Melka Marine, Inc. (“Melka”) appeals from the decision of the United States Court of Federal Claims, dismissing Mel-ka’s complaint which sought damages in connection with a waterfront construction contract awarded by the United States Department of the Navy. See Melka Marine, Inc. v. United States, 41 Fed.Cl. 122 (1998). After denying a motion and cross-motion for summary judgment, the Court of Federal Claims conducted a one-day trial on November 24, 1997.
