BLACKMUN, Circuit Judge.
This is an appeal from the judgment entered upon a jury verdict that the defendant Beatrice Foods Co. was guilty of a conspiracy made illegal by § 1, as amended, of the Sherman Act, 15 U.S.C. § 1. A fine of $15,000 was imposed.
The indictment was returned in August 1958. It named Beatrice, Roberts Dairy Company and Alamito Dairy Company as defendants. All three defendants were engaged in the dairy business in the Omaha-Council Bluffs area.
