NEBEKER, Associate Judge:

Appellant Hutchison Brothers appeals the trial court’s order granting the District of Columbia’s motion for summary judgment on the question of appellant’s liability for motor vehicle fuel taxes for the period from April 1976 through March 1981. In granting summary judgment for the District, the trial court ordered the District to initiate a rulemaking proceeding pursuant to the District of Columbia Administrative Procedure Act (DCAPA), D.C. Code § 1-1501 et seq. (1973 & 1977 Supp.), to interpret and implement the Motor Vehicle Fuel Tax Act, D.C.Code § 47-1901 et seq.…
