In this cause the appellant, C. W. Dobbins, and appellee, the Texas Company, occupy their relative trial positions, and will hereinafter be referred to as plaintiff and defendant, respectively.

The litigation arose out of another action brought by plaintiff against one E. II. Roy'er to establish a trust in a certain producing 160-acre oil and gas lease, and for an accounting of the administration of the trust property, in which cause plaintiff recovered a 75/256th'part in on'e-half of seven-eighths of the leasehold, and a money judgment of $76,187.58, as his share in like moiety of…
