PATTERSON, J. pro tem.

Plaintiff was a member of the defendant union and was purportedly expelled. Defendant appeals from a judgment in a mandamus proceeding directing the reinstatement of plaintiff in the union and awarding him damages for loss of earnings which resulted from the expulsion.

The plaintiff joined with other members of the union in opposing the adoption of a new constitution. This group published a paper which was highly critical of the union’s officers and their conduct of the union.
