Plaintiff was employed by T. Miller Sons, who was insured by The Employers' Liability Assurance Corporation, Ltd., as a corporation engaged in the building of houses in the Parish of Calcasieu, some 12 miles southwest of the City of Lake Charles. The employer furnished transportation to and from the work, and on January 26, 1944, at about 6:30 A.M., while this employee was being transported to his employment, in a truck owned by the employer and operated by another employee, a collision occurred between said truck and a U.S. Army truck being operated by a member of the U.S. Army forces.
