Action under the Federal Employers' Liability Act. On the former appeal [Poe v. Illinois Central Railroad Co., 335 Mo. 507,73 S.W.2d 779], judgment for plaintiff was reversed and the cause remanded because the evidence was insufficient to establish negligence on the part of defendant. Upon retrial, plaintiff prevailed; but the court nisi granted a new trial on the ground the verdict was against the weight of the evidence. A third trial resulted in a verdict for plaintiff in the sum of $20,000; and upon plaintiff entering a forced remittitur of $10,000, judgment was rendered for $10,000.…
