After plaintiff John B. Smith had recovered a judgment in the circuit court for $1500, against defendant St. Louis Public Service Company, for personal injuries sustained in an automobile collision with a streetcar, the defendant appealed to the St. Louis Court of Appeals. That court ordered the judgment reversed and the cause remanded for new trial, 252 S. W. (2) 83. Upon defendant’s petition therefor, we ordered the cause transferred here to examine the opinion of the Court of Appeals with respect to the propriety of that court’s order to remand the cause for new trial.
