WATERMAN, Circuit Judge:
This is an appeal from a judgment of the United States District Court for the Southern District of New York dismissing the appellant’s complaint and the defendant’s complaint against impleaded third parties. This litigation has been the subject of three much-discussed previous opinions. In the original hearing of the action before the district court summary judgment was granted in favor of the defendants, D.C., 193 F.Supp. 375 (1961).
