Plaintiff-appellant, American National Bank and Trust Company, as Trustee under Trust Agreement, No. 11152, brought suit in the District Court to recover damages of $75,000 (plus interest and attorneys’ fees for vexatious delay) consequent on collapse of the roof of plaintiff’s garage building in Chicago, Illinois, on January 27, 1967.
