BEACH, J.

The plaintiffs, William P. Mara, Jr., and Suzan M. Mara, appeal from the summary judgment rendered by the trial court in favor of the defendant, Karen Otto, as to William Mara’s claim and the resulting dismissal of Suzan Mara’s derivative claim. See footnote 1 of this opinion. On appeal, the plaintiffs claim that the court erred in concluding that no genuine issue of material fact existed as to whether the defendant’s allegedly defamatory statements regarding William Mara were made with malice. We affirm the judgment of the trial court.
