Clarke v. Clarke
Supreme Court of Oklahoma
1Opinion of the CourtHurst, J.
This is a suit by George W. Clarke, as plaintiff, against Fred C. Clarke and Mae Bodine Clarke, husband and wife, to recover on three promissory notes and to foreclose a real estate mortgage given to secure the indebtedness represented by the notes. The plaintiff alleged that the notes sued on constituted the third renewal of the mortgage indebtedness. The defendants were served by publication notice. Fred C. Clarke made default. Mae Bodine Clarke filed an answer denying that she was personally liable on the notes and alleging that the mortgage is barred by the statute of limitations.
