OPINION

ALLEGRA, Judge:

This action, which is before the court on defendant’s motion for summary judgment and plaintiffs cross-motion for partial summary judgment, has its genesis in a loan agreement between Parkwood Associates Limited Partnership (plaintiff) and the Farmers Home Administration (FmHA) to establish low income rural housing projects pursuant to section 515 of the Federal Housing Act.
