The State petitioned this Court for review of the Court of Appeals’ opinion, Oldham v. State, 889 S.W.2d 461 (Tex.App.—Houston [14th Dist.] 1994), which held that the appellant was denied counsel at a critical stage of the proceedings, and which abated the appeal and remanded the cause to the trial court to allow the appellant to file an out-of-time motion for a new trial.
