MEMORANDUM OF DECISION ON THIRD-PARTY DEFENDANT’S OBJECTION TO JULY 17, 1987 RULING OF THE MAGISTRATE

EGINTON, District Judge.

This is a products liability action brought by plaintiffs who were either injured or killed by an exploding propane tank. The complaint, filed on July 31, 1984, names two defendants: Philips Industries, Inc., manufacturer of the allegedly defective tank, and Hurricane Products, Inc., distributor of the tank. On December 26, 1985, Philips moved to implead Hamai Industries, Ltd., the Japanese manufacturer of the valve assembly. The third party complaint alleges that…
