Appeal from final judgment in favor of defendants, on demurrer to the complaint. The following are the material facts in the case:
In March, 1869, Wither by commenced an action in the District Court of the Eighteenth Judicial District, against one Charles Thomas, for the recovery of the sum of twenty-five hundred dollars, and procured an attachment to be issued therein which was levied upon certain cattle including forty-five head of California stock, and two animals known as “graded cows,” the latter being of the value of one thousand and forty dollars, and the entire value of…
