Appellant caused this suit to be instituted against appellee individually and as independent executrix of the will and estate of S. W. S. Duncan, deceased, to recover damages alleged to have been siis-tained by appellant on account of appellee’s testator selling and delivering to appellant, on the 26th day of August, 1902, an incomplete abstract of title to a' certain tract of land, accompanied by false certificate.
