Appeal from Zavala County Court; H. O. Stubbs, Judge. Action by the Pegues Mercantile Company against the Gulf Refining Company. Judgment for plaintiff, and defendant appeals.

This suit originated in the justice’s court, precinct No. 3, of Zavala county, Tex., where the plaintiff obtained a judgment, whence it was appealed to the county court of that county, and there the plaintiff below again prevailed. The Gulf Refining Company has appealed to this court.

The controversy grows out of a contract made between the parties, the material parts of which, so far as we are concerned, are as follows; “This contract made and entered into this 15th day of January, 1912, between the Gulf Refining Company of Port Arthur, Texas, first party, and Pegues Merc.
