This suit was brought by appellant against appellees S. M. Rosa-mond and S. S. Day, composing the firm of Rosamond & Day. The purpose of the suit was to recover damages for the loss of timber upon lands leased the defendants by plaintiff under a contract by the terms of which defendants, upon the payment of the consideration named in said contract, were granted the right to extract the turpentine and resin in the pine trees growing upon said land and agreed to pay plaintiff for all trees that were killed or died as a result of defendants’ operations in extracting the turpentine therefrom…
