This appeal is duly prosecuted by appellants, Carl Metzger and David Metzger. The basis of this appeal is: On December 2, 1929, in a district court of Dallas county, appellee, Yera Gambill, was awarded judgment by default against appellants with writ of inquiry. On the same day the writ of inquiry was perfected, on proof of claim, damages assessed against appellants in the sum of $2,500, and judgment duly entered for said amount.
