This suit was filed by appellee, John R. Lawrence, against appellant, St. Louis Southwestern Railway Company of Texas, to recover damages for personal injuries sustained by appellee as’ the result of alleged negligence of appellant. Plaintiff alleged that he was an employee of the defendant in the capacity of brakeman on its freight and passenger trains in the state of Texas.
