Appellee sued appellant to recover damages alleged to have accrued by reason of the negligent failure of appellant to promptly transmit and deliver to appellee a message sent to her informing her of the death of her daughter. The suit was filed on November 19, 1908, and- on December 1, 1908, which was appearance day for the District Court of Nueces County, about 11 o’clock in the forenoon, no answer having been filed judgment by default was taken by appellee against appellant, and at 2:17 o’clock in the afternoon of the same day an answer was filed by appellant.
