The plaintiff in error, hereinafter referred to as defendant, was charged by information filed in the county court of Payne County in case-No. 8386 with the offense of leaving the scene of a collision; and also charged'in the same court in case No. 8387 with the- offense of operating, a-motor vehicle while under the influence of intoxicating liquor* being misdemeanors, and arising out of the same state of facts.
