The plaintiff in error, A. D. Martin, who hereinafter will be referred to as defendant, as in trial court, was charged by indictment filed in the district court of Pittsburg county, with the crime of embezzlement, was tried and convicted, with punishment assessed at imprisonment in the State Penitentiary for one year and one day.

The prosecution in this case was instituted under the provisions of section 1454 of Title 21 O.S. 1941, which reads:

“If any person being a trustee, banker, merchant, broker, attorney, agent, assignee in trust, executor, administrator or collector, or being otherwise…
