Appeal from St. Louis City Circuit Court. — Hon. Jacolo Klein, Judge. (1) The court erred in refusing to substitute King as plaintiff in the case. R. S. 1889, sec. 2204; Childs v. (2) It was erroneous to permit defendant King to be questioned as to the rate of interest usually charged by the National Loan Company in its business and as to his testimony on this point on the former trial.

This is an action in replevin begun before a justice of tbe peace in tbe city of St. Louis. Tbe statement, affidavit and bond are in statutory form, and the property under the order of the justice was taken by -the constable from the possession of the defendants, and delivered to the plaintiff.
The property was claimed by the plaintiff under a chattel mortgage, as follows:
