MEMORANDUM OPINION AND ORDER

GESELL, District Judge.

This is an action under 35 U.S.C. § 146 to set aside a determination by the Patent Office in an interference proceeding awarding to. defendants rights of priority to a patent involving a heat resistant plastic called Polybicycloarylsulfones. The case is now before the Court on defendants’ motion for summary judgment, plaintiffs’ motion to remand the case to the Patent Office, and the oppositions thereto.
