In this case appellee has filed her motion to dismiss the appeal. She grounds her motion, among other things, on the absence of the evidence from the record. An examination of the record discloses that the only error properly assigned is based on the overruling of appellant’s motion for a new trial. The other errors attempted to be assigned seek to raise questions that could only be presented in a motion for a new trial, and are therefore not proper assignments of error. An examination of the motion for a new trial discloses that all of the reasons on which it is based depend on the evidence.…
