Plaintiff in error (hereinafter called the defendant) was convicted of an assault with intent to do great bodily harm and brings writ of error to review the judgment. Shields was night watchman of the city of Boscobel. A parade, consisting of members of the Ku Klux Klan, marched along the main street of said city on the night of August 16, 1924. The parade consisted of both men and women. They wore the regulation regalia of the Ku Klux Klan, consisting of masks and long robes.
