This cause bas been reported by the judge of the first circuit, under section 8, cbap. 180, E. S., in order to obtain the decision of tbis court upon certain questions of law arising upon the trial. Tbe report is made at the request of the defendant, and the circuit judge states in bis certificate that be *218considers these questions of such, importance and so doubtful as to require the decision of this court upon them.
