OPINION AND ORDER

NORGLE, District Judge.

Before the court are cross motions for summary judgment. For the following reasons, Defendants’ motion is granted and Plaintiffs motion is denied.

I. BACKGROUND

As a preliminary matter, the undisputed facts for this opinion are taken from the court’s reconciliation of the parties’ Local Rule 12(M) and 12(N) statements. See Bra-sic v.
