SWINFORD, District Judge.

This case is now before me for a determination of the sufficiency of what have been denominated “The Special Defenses.” It has been the endeavor of the attorneys, both for the defendants who are making these special defenses and those for the plaintiff, to classify them into distinct groups. It is my understanding from oral arguments and from briefs that the questions briefed are common to a great number of the defendants and that, while there may be distinguishing facts in each case, a ruling on the questions at law presented in briefs will largely determine the…
