This is an appeal by plaintiff from a judgment entered after the court had sustained a demurrer to the third amended complaint.

The complaint which was last filed recited that the defendant corporation was erecting and installing the terra cotta work on a building belonging to defendant Phebe A. Hearst and located at the corner of Third and Market streets in the city and county of San Francisco; that on January 5, 1911, Gladding, McBean & Co., the said corporation, was engaged in said work “with the knowledge and consent” of Mrs. Hearst and under her direction, and at the same time other…
