Presently pending in this civil action is a motion filed by plaintiff That’s Entertainment, Inc. (“TEI”) seeking summary judgment as to the issue of liability. Plaintiff TEI has alleged in its complaint that on June 19, 1992, defendants J.P.T., Inc. (“JPT”) and James P. Thomas unlawfully intercepted and broadcast to the patrons of the Colonial Inn a professional heavyweight boxing match between Evander Holyfield and Larry Holmes.
