I. INTRODUCTION

These consolidated appeals arise out of the granting of a preference right to Loyd Messerli by the Commissioner of the Alaska Department of Natural Resources (DNR). Messerli filed two lawsuits in connection with the preference right. In the first appeal, Messerli challenges a decision of Judge John Bosshard III finding no procedural irregularities in the DNR’s granting of his preference right.
