A rehearing was granted in this case for the purpose of modifying the statement of facts contained in the original opinion, of which the appellant complains. After again reviewing the record we are convinced the original opinion correctly declares the law applicable to the facts of this case. With certain modifications the original opinion is therefore adopted as follows:
