Plaintiff appeals the trial court’s judgment for defendant, dismissing plaintiff s tort action after a bifurcated trial, on the ground that defendants are immune from liability because plaintiffs claim was covered under workers’ compensation law. See ORS SONSS^Xa). We reverse, because plaintiff is an independent contractor, not an employee.

On review, we are bound by the trial court’s findings if they are supported by any evidence in the record. Illing-worth v. Bushong, 297 Or 675, 694, 688 P2d 379 (1984). Based on those facts, we review to determine if the trial court erred as a matter of law…
