This matter previously came before the Court on defendant’s objections to the Recommendation of Magistrate Judge Aaron E. Goodstein granting plaintiffs motion for a preliminary injunction. At that time, the Court sustained defendant’s objection, declined to follow the Magistrate’s Recommendation and denied plaintiffs request for an injunction. The matter now comes before the Court on the parties’ cross-motions for summary judgment.
