Appeal from a judgment of the superior court for Spokane county, Hurn, J., entered April 17, 1920, upon the verdict of a jury rendered in favor of the plaintiff, in an action on an insurance policy.

1Opinion of the CourtBridges, J.

There are two distinct branches to this case. The first concerns the liability of the Westchester Fire Insurance Company on a policy of insurance issued by it, and the second is to determine who is ultimately to receive the insurance money in the event we hold the insurance company liable.

We will proceed at once to the first branch. This part of the case was tried to a jury, which returned a verdict against the insurance company.
