The defendant appeals herein from a judgment in favor of plaintiff in an action to quiet title and to set aside a trustee’s sale under power of sale in a trust deed, and to cancel the deed executed pursuant thereto, or to compel a reconveyance of the property. The essential facts may be stated as follows: On February 15, 1918, one E. W. Myers, who was then the owner of the property involved herein, executed a trust deed conveying the same to Frank D. Hevener, trustee for the International Bank as beneficiary, to secure the payment -of principal sums aggregating $5,000, together with interest…
