Emil Wirth was charged in the county court of Garfield county with the crime of driving a motor vehicle upon the public highway while under the influence of intoxicating liquor, was tried, convicted, sentenced to pay a fine of $50 and costs, and has appealed.

In his petition, defendant sets out ten assignments of error, but in his brief urges only three, as follows:
