POWELL, Judge.

The plaintiff in error, Martin Edwards, hereinafter referred to as defendant, was *1024charged in the district court of Tulsa County with the crime of unlawful transportation of intoxicating liquor, second and subsequent offense; was tried before a jury and convicted, but the jury being unable to agree upon the punishment to be assessed, left that to the court, who assessed the penalty at a fine of $1,000, and imprisonment in the State Penitentiary at McAlester for a period of one year.
