HAWKINS, Judge.

Appellant was indicted for murder growing out of the killing of Sadie Peoples. Conviction for manslaughter resulted with an assessed punishment of two years in the penitentiary.

Deceased was killed by being shot with a pistol, the first of two shots inflicting only a slight flesh wound in the shoulder, the other causing death. Appellant is a white man, having come to this country from Silesia. Deceased was a negro woman.
