HENDERSON, Judge.

Appellant was convicted of murder in the second degree, and his pnnishmeut assessed at confinement in the penitentiary for a term of twenty years; hence this appeal.

The homicide grew out of a letter written by deceased for one Adams to neighbors, sheriff of Pecos County, reflecting on appellant, appellant being at the time deputy sheriff of Pecos County under said Heigh hors. The killing occurred at night, in the rear portion of the drugstore, in front of which was the postoffice.
