HENDERSON, Judge.

Appellant was convicted of murder in the second degree, and his punishment assessed at eighteen years confinement in the penitentiary; and prosecutes this appeal.

A summary of the facts shows that appellant and deceased were negroes, and lived in the town of Bosebud. Appellant was a brother-in-law of deceased, having married his sister, and occupied a house over which deceased had control, which was situated a short distance from where deceased lived.
