Appeal from District Court, Travis County ; Geo. Calhoun, Judge. Suit by W. D. C. Burney, on whose death Martha Burney, as executrix, was substituted, against J. G. Burney. Judgment for plaintiff, and defendant appeals.

W. D. C. Burney, as plaintiff below, brought suit against J. G. Burney on March 14, 1917, in the district court of Travis county, to establish his interest in certain blocks of land situated in the city of Austin, for rents, and for partition of the land or sale thereof in case partition were found impracticable. The case was submitted to a jury on special issues, and based on their findings the court rendered judgment for the plaintiff, and appointed a receiver to sell the property. Before trial, however, W.
