As part of Multi-District Litigation No. 1313, AT & T Fiber Optic Cable Installation Litigation, defendant AT & T Corporation has moved for summary judgment on the claims of several plaintiffs who own property adjoining railroad rights of way that were established under federal legislation to promote railroad construction in settling the American West. 1 Acting under lease agreements with the railroads, defendant AT & T buried and is operating fiber optic telecommunications cables in the land…
