The plaintiffs, Robert E and Loretta N. Brouillard, appeal a ruling of the Superior Court {Morrill, J.) denying a petition for declaratory judgment. The Brouillards sought to establish their right to underinsured motorist benefits from the defendant, Prudential Property & Casualty Insurance Company (Prudential). We affirm.

The trial court found the following facts. On March 1, 1989, Robert Brouillard was injured while riding as a passenger in an automobile operated by Philip Bourgoine. Mr. Brouillard collected $100,000 from Bourgoine’s insurance carrier for his injuries. The Brouillards then…
