The Cincinnati Insurance Company (“Cincinnati”) filed a complaint for a declaratory judgment that it owes no duty to defend or indemnify claims brought against its insured, All Plumbing, Inc. and its president (together, “All Plumbing”), for sending unsolicited faxed advertisements alleged to be in violation of the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. § 227.
